Passenger Agreement & Liability Waiver

1. Acceptance of Terms

By booking, boarding, or using any service provided by TOURA LLC ("TOURA,” "we,” "our,” or "us”), you agree to these Terms & Conditions and acknowledge that you have read, understood, and accepted this Passenger Agreement and Liability Waiver.

If you do not agree, do not use our services.


2. Nature of Services

TOURA provides:

  • On-demand transportation
  • Scheduled tours
  • Event and nightlife transport
  • Guided experiences
  • Recreational vehicle transport (including side-by-side vehicles where applicable)

TOURA is a transportation facilitator and may use:

  • Employees
  • Independent contractors
  • Third-party drivers

3. Assumption of Risk

Passenger acknowledges that transportation and tour activities involve inherent risks, including but not limited to:

  • Vehicle accidents
  • Road hazards
  • Weather conditions
  • Mechanical failure
  • Other drivers’ negligence
  • Passenger behavior
  • Outdoor terrain conditions (for off-road or side-by-side use)

By using TOURA services, passenger voluntarily assumes all inherent risks associated with transportation and recreational vehicle travel.


4. Release of Liability

To the fullest extent permitted by law, passenger agrees to release, waive, and discharge TOURA LLC, its owners, officers, employees, contractors, and affiliates from any liability for:

  • Personal injury
  • Death
  • Property damage
  • Emotional distress
  • Indirect or consequential damages

arising out of or related to the use of TOURA services, except where caused by gross negligence or willful misconduct.


5. Seatbelts and Safety Compliance

Passengers agree to:

  • Wear seatbelts when available
  • Follow driver safety instructions
  • Remain seated when vehicle is in motion
  • Avoid distracting the driver

Failure to follow safety instructions may result in termination of service without refund.


6. Passenger Conduct

Passengers must not:

  • Engage in illegal activity
  • Damage vehicle property
  • Harass the driver
  • Bring open containers of alcohol where prohibited
  • Carry illegal substances
  • Smoke or vape unless permitted

TOURA reserves the right to refuse or terminate service for unsafe or unlawful conduct.

Passenger may be financially responsible for any damages caused.


7. Alcohol & Nightlife Services

Passengers using nightlife transportation services acknowledge:

  • Drivers may refuse service to visibly intoxicated individuals who pose a safety risk.
  • TOURA does not assume responsibility for passenger behavior before or after transport.
  • Passenger remains responsible for lawful conduct.

8. Property Damage & Cleaning Fees

Passenger agrees to be responsible for:

  • Damage to vehicle
  • Excessive cleaning due to spills, bodily fluids, or other messes
  • Repair costs resulting from passenger conduct

Additional charges may be assessed.


9. Recording & Monitoring Disclosure

Vehicles may utilize:

  • GPS tracking
  • Dash cameras
  • Interior video recording
  • Audio recording (where legally permitted)

Recordings may be used for:

  • Insurance claims
  • Safety monitoring
  • Legal protection
  • Dispute resolution

By entering a TOURA vehicle, passenger consents to recording.


10. Limitation of Liability

TOURA’s maximum liability for any claim arising from services shall not exceed the amount paid for the specific ride or tour in question.

Under no circumstances shall TOURA be liable for:

  • Lost profits
  • Lost business opportunities
  • Indirect damages
  • Punitive damages

11. Independent Contractor Status

Some drivers may operate as independent contractors.

Passenger agrees that:

  • TOURA acts as a booking and service facilitator.
  • Drivers are responsible for operating vehicles in compliance with applicable laws.

12. Insurance Disclosure

TOURA maintains commercial insurance coverage as required by applicable law.

Insurance coverage limits and applicability may vary depending on:

  • Vehicle type
  • Nature of service
  • Operational status at time of incident

Passenger acknowledges that insurance does not eliminate inherent transportation risks.


13. Weather & Force Majeure

TOURA is not liable for delays, cancellations, or service interruptions caused by:

  • Weather
  • Road closures
  • Government actions
  • Mechanical breakdown
  • Events beyond reasonable control

14. Cancellations & Refunds

Cancellation policies may vary depending on service type.

Refunds are issued at TOURA’s discretion unless otherwise required by law.


15. Indemnification

Passenger agrees to indemnify and hold harmless TOURA LLC from claims resulting from:

  • Passenger misconduct
  • Violation of laws
  • Damage caused by passenger
  • False claims or fraudulent activity

16. Governing Law

These Terms are governed by the laws of the State of Idaho.

Any disputes shall be resolved in the courts located in Idaho.


17. Severability

If any provision of this agreement is found unenforceable, the remaining provisions remain in effect.


18. Entire Agreement

These Terms constitute the entire agreement between passenger and TOURA LLC regarding services provided.
